Privacy Notice and Express Authorization for the Processing of Personal Data

Blackbird Labs S.A.S., a commercial company incorporated under Colombian law, identified with Tax ID (NIT) 901.465.357-8, domiciled in Cartagena, Bolívar, at Carrera 3 # 6a – 100, Edificio Torre Empresarial Protección, Office 809 (hereinafter, the "Data Controller"), in compliance with Colombian Law 1581 of 2012, Regulatory Decree 1377 of 2013, and our Personal Data Processing Policy, hereby informs you that, in its capacity as Data Controller, it will process your personal data for the following purposes, depending on the applicable data subject category:

Clients:

  • a) Carrying out the actions necessary for the development of the corporate purpose of the Data Controller.
  • b) Fulfilling the purpose of the service to be provided to the Client.
  • c) Sending event invitations.
  • d) For commercial, administrative, marketing, and sales purposes.
  • e) Conducting satisfaction surveys regarding the services offered by the Data Controller.
  • f) Contacting the data subject through any means (phone, SMS, or electronic chat) to conduct surveys, studies, and/or confirm personal data necessary for the performance of the contractual or commercial relationship.
  • g) Contacting the data subject through any means to send news related to loyalty or service-improvement campaigns, promotions, and advertising/marketing.
  • h) Contacting the data subject by email or any other means agreed upon by the parties to send statements, account summaries, invoices, and collection and/or payment notices related to the obligations arising from the contract entered into between the parties.
  • i) Providing information to third parties with whom the Data Controller has, or may come to have, a contractual or commercial relationship, where such disclosure is necessary to fulfill the contracted purpose.
  • j) Informing data subjects about data-update campaigns and changes to the processing of personal data.
  • k) Filing complaints, reports, or notices with the competent authorities or entities in the event of breach of contracts or agreements.
  • l) Contacting the data subject through any means for statistical purposes and for recording the entry and exit of documents.
  • m) Engaging in conversations, service offers, and advisory interactions through tools such as chatbots.
  • n) Generating sales and purchase statistics.
  • o) Billing and collections management.
  • p) Complying with requirements from administrative and judicial authorities.
  • q) Verifying commercial, financial, or restrictive-list background information, where applicable and in accordance with the law.
  • r) Scheduling appointments, reserving spaces, using the Coworking facilities, and anything related to access to the coworking space.
  • s) Recording entry to and exit from the facilities.
  • t) Preparing quotes for possible services based on specific needs.
  • u) Analyzing the services required.
  • v) Generating records of commercial relationship history.
  • w) Developing marketing strategies and sending related communications.
  • x) Conducting opinion surveys regarding services provided.
  • y) Managing customer service and related matters.
  • z) Requesting and sending budgets/quotes.
  • aa) Sending payment notifications.
  • bb) Sending accounting and tax information.
  • cc) Taking photographs and video recordings during visits to the facilities of the Data Controller.
  • dd) Sending mass advertising campaigns offering services provided by the Data Controller and any of its affiliates and/or subsidiaries.
  • ee) Complying with legal and tax obligations.
  • ff) The data provided may be used in marketing strategies carried out by the Data Controller.
  • gg) Verifying commercial, financial, or restrictive-list background information, where applicable and in accordance with the law.
  • hh) Ensuring the safety of people and property within the facilities.
  • ii) Responding to complaints, claims, or requests.

Likewise, we inform you that, as the Data Subject, you have the right to: 1. Access, free of charge, the data provided that has been subject to processing. 2. Know, update, and correct your information in the case of partial, inaccurate, incomplete, fragmented, or misleading data, or data whose processing is prohibited or has not been authorized. 3. Request proof of the authorization granted. 4. File complaints with the Superintendency of Industry and Commerce (SIC) aimed at investigating violations of applicable law. 5. Revoke the authorization and/or request deletion of the data, provided there is no legal or contractual duty preventing its deletion. 6. Be informed by the Data Controller, upon request, of the use given to your personal data. 7. Refrain from answering questions about sensitive data or data concerning children and adolescents. You may consult our Policies on our website or at the premises of the Company. You may also exercise the rights mentioned above by writing to administracion@blackbirdlabs.co.

BLACKBIRD LABS S.A.S. reserves the right to update the content of this Personal Data Processing Policy at any time. Any changes will be communicated in a timely manner through our usual communication channels.

Having read the foregoing, I give my prior, express, and unequivocal authorization to the Company for the processing of the personal data provided by me. I declare that I am the Data Subject of the information provided, that I am authorized to consent to the processing of my personal data, that I have provided it voluntarily, and that it is complete, reliable, truthful, and accurate. I likewise authorize the transfer of my data to third-party entities with which the Company has an operational relationship, that provide services necessary for the proper operation of the Company, or in the event of the sale of the Company or any of its business units.
